The Fire Garden website is designed to help customers explore, configure, and select Fire Garden products online before connecting with an Authorized Fulfilment Center to coordinate the order locally.

By using this website, configuring a product, submitting an order, or otherwise using Fire Garden’s services, you agree to these Terms & Conditions.

If you do not agree with these terms, please do not use this website or submit an order.

1. About Fire Garden

Fire Garden provides premium outdoor fire features, burners, fire pits, torches, lanterns, accessories, and related products.

Fire Garden’s website allows customers to explore available products and configurations and submit orders or product selections online.

Fire Garden operates through a network of Authorized Fulfilment Centers that assist customers with local order coordination and fulfillment.

Fire Garden does not operate as a traditional direct-to-consumer shipping retailer. Products are not shipped directly from Fire Garden to customers.

2. Fire Garden Fulfilment Model

Fire Garden is designed to help customers configure their ideal fire feature online and then connect with a local Authorized Fulfilment Center to finalize and fulfill the order.

Fire Garden does not directly fulfill or ship customer orders. Products purchased through the Fire Garden website are not shipped directly from Fire Garden to the customer’s address.

When submitting an order, customers select an available Authorized Fulfilment Center. The selected center will work with the customer to confirm the product configuration and coordinate the next steps.

After an order is submitted, the selected Authorized Fulfilment Center may contact the customer to:

• Confirm product selections and configuration
• Review project and site requirements
• Confirm pricing and product availability
• Coordinate order fulfillment
• Arrange pickup from the fulfillment center
• Discuss available local delivery options
• Discuss installation or other project-related services
• Answer questions about the product and its installation requirements

Depending on the location and services offered by the selected Authorized Fulfilment Center, completed orders may be picked up by the customer or delivered locally by the fulfillment center.

Delivery availability, delivery fees, scheduling, installation services, and other local services vary by Authorized Fulfilment Center and location and are not guaranteed to be available in every area.

By submitting an order through the Fire Garden website, you acknowledge that the website is intended to facilitate product configuration and connect you with your selected Authorized Fulfilment Center for local order coordination and fulfillment.

3. Authorized Fulfilment Centers

An Authorized Fulfilment Center is an independent business authorized to assist with the local fulfillment of Fire Garden products.

Customers select an Authorized Fulfilment Center during the ordering process based on the available locations.

The selected Authorized Fulfilment Center is responsible for coordinating the local fulfillment of the customer’s order.

An Authorized Fulfilment Center may provide additional services, including:

• Product pickup
• Local delivery
• Installation
• Site evaluation
• Project coordination
• Permitting assistance
• Site preparation
• Additional materials or components
• Other related services

Additional services provided by an Authorized Fulfilment Center may be subject to separate pricing, agreements, terms, and conditions between the customer and the fulfillment center.

Fire Garden does not control the pricing, availability, scheduling, workmanship, or other terms of services independently provided by an Authorized Fulfilment Center.

Services offered by Authorized Fulfilment Centers may vary by location.

4. Product Information

Fire Garden makes reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, finishes, colors, and other information displayed on the website are accurate and current.

However, actual products may vary slightly from photographs or displayed representations.

Natural materials and finishes, including glass, stone, logs, metal finishes, and other decorative materials, may have variations in color, texture, size, shape, and appearance.

Product dimensions and specifications may also change as manufacturers update products or components.

Fire Garden reserves the right to correct typographical errors, inaccuracies, omissions, or outdated information at any time.

Product availability is not guaranteed until the order has been confirmed.

Custom or non-standard products may be subject to additional restrictions regarding cancellation, modification, return, or exchange.

6. Pricing

Prices displayed on the Fire Garden website are subject to change without notice.

Unless otherwise stated, displayed prices may not include:

• Delivery

• Site preparation
• Permitting
• Electrical work
• Gas work
• Additional construction or materials
• Applicable taxes

Your selected Authorized Fulfilment Center may provide additional pricing for services or materials that are not included in the Fire Garden product price.

Fire Garden reserves the right to correct pricing errors. If an order has been submitted using an incorrect price, Fire Garden or the Authorized Fulfilment Center may contact you to confirm whether you wish to proceed at the correct price.

7. Orders and Order Acceptance

Submitting an order or product configuration through the Fire Garden website does not necessarily constitute final acceptance of the order.

An order is considered accepted when Fire Garden or the applicable Authorized Fulfilment Center confirms the order.

Fire Garden reserves the right to refuse, cancel, or modify an order when necessary, including due to:

• Product availability
• Pricing errors
• Configuration issues
• Manufacturer limitations
• Supply limitations
• Suspected fraud
• Other legitimate business reasons

If an order is canceled after payment has been received, any applicable refund will be processed according to these Terms & Conditions and the circumstances of the cancellation.

8. Site Conditions and Customer Responsibilities

Fire Garden products involve combustion, heat, gas, electricity, and other potentially hazardous conditions.

Before purchasing or installing a Fire Garden product, the customer is responsible for ensuring that the proposed installation location is suitable for the selected product and complies with all applicable requirements.

These requirements may include:

• Building codes
• Fire codes
• Fuel-gas codes
• Electrical codes
• Zoning requirements
• Manufacturer requirements
• Clearance requirements
• Ventilation requirements
• Other applicable laws and regulations

Customers are responsible for providing accurate information regarding their project, including measurements, dimensions, fuel type, site conditions, intended use, and other information relevant to the selected product.

Customers should obtain professional advice when required to determine whether a particular product and configuration are appropriate for their project.

9. Installation

Unless expressly stated otherwise in writing, the purchase of a Fire Garden product does not include installation.

Installation should be performed by appropriately qualified professionals and in accordance with applicable codes, regulations, manufacturer instructions, and product requirements.

Customers are responsible for obtaining any permits, inspections, approvals, or professional services required for their installation.

Installation services may be available through an Authorized Fulfilment Center or another qualified service provider.

Fire Garden is not responsible for installation work performed by an independent contractor, Authorized Fulfilment Center, dealer, installer, or other third party unless Fire Garden has expressly agreed in writing to provide that installation service.

10. Fuel and Utility Requirements

Customers are responsible for ensuring that the selected product is compatible with the fuel and utilities available at the installation site.

Depending on the product, this may include natural gas, propane, electrical service, or other required utilities.

Fuel and utility connections must be installed and serviced by appropriately qualified professionals where required by law.

Incorrect fuel type, improper installation, inadequate gas supply, improper electrical connections, insufficient ventilation, or failure to follow installation instructions may result in property damage, personal injury, or product failure.

11. Safety

Fire Garden products are designed to produce an open flame and/or substantial heat and must be used responsibly.

Customers are responsible for reading and following all product instructions, warnings, installation requirements, operating instructions, and safety information provided with the product.

Never leave an operating fire feature unattended.

Keep children, pets, combustible materials, and other hazards away from operating fire features.

Fire Garden products should only be used for their intended purpose and in accordance with applicable laws, codes, manufacturer requirements, and safety instructions.

12. Changes and Cancellations

Requests to change or cancel an order should be made as soon as possible.

Once an order has entered production, procurement, customization, or fulfillment, changes or cancellations may not be possible or may be subject to charges.

Custom-configured, made-to-order, special-order, or non-stock products may be non-cancellable and non-returnable once production or procurement has begun.

Any applicable cancellation fees or refunds will be determined based on the status of the order and any costs already incurred.

Customers should contact their selected Authorized Fulfilment Center or Fire Garden as soon as possible regarding a requested change or cancellation.

13. Returns and Exchanges

Return eligibility varies depending on the product and whether it is standard, custom-configured, made-to-order, or specially procured.

Products must be returned in accordance with Fire Garden’s return authorization procedures. Unauthorized returns may not be accepted.

Returned products must generally be unused, undamaged, and in their original packaging unless otherwise approved by Fire Garden.

Custom-configured, personalized, modified, made-to-order, special-order, or otherwise non-standard products may not be eligible for return.

Shipping, handling, restocking, customization, and other applicable charges may be deducted from any approved refund.

Fire Garden reserves the right to inspect returned products before issuing a refund or exchange.

14. Pickup and Local Delivery

Fire Garden products are not shipped directly to customers by Fire Garden.

Completed orders are coordinated through the Authorized Fulfilment Center selected by the customer.

Depending on the location and services offered by the selected center, the customer may:

• Pick up the completed order from the Authorized Fulfilment Center; or
• Arrange local delivery through the Authorized Fulfilment Center.

Local delivery may be subject to additional fees, service-area limitations, scheduling requirements, site-access requirements, and other conditions established by the fulfillment center.

The customer is responsible for ensuring that the delivery location is reasonably accessible and suitable for receiving the product.

Delivery does not necessarily include unloading, placement, assembly, installation, or site preparation unless those services have been separately arranged.

15. Damaged or Incorrect Products

Customers should inspect products promptly upon pickup or delivery.

If a product appears damaged, incorrect, or incomplete, customers should notify their Authorized Fulfilment Center or Fire Garden as soon as reasonably possible and provide photographs and other requested information.

Failure to promptly report damage or discrepancies may affect the ability to pursue a claim.

16. Product Availability and Substitutions

Fire Garden products and components may occasionally become unavailable due to manufacturer changes, supply limitations, discontinued components, or other circumstances beyond our control.

When appropriate, Fire Garden or the applicable Authorized Fulfilment Center may offer an equivalent or reasonably comparable component or product.

No substitution will be made where it would materially alter the customer’s selected product without the customer’s approval, unless otherwise permitted by the applicable manufacturer or order terms.

17. Warranty

Fire Garden products may be covered by manufacturer warranties or Fire Garden warranties, depending on the specific product.

Warranty coverage, duration, exclusions, and claim procedures vary by product.

Warranty coverage may require installation and maintenance to have been performed in accordance with applicable instructions and requirements.

Damage caused by improper installation, misuse, modification, neglect, improper fuel or utility connections, unauthorized repairs, accidents, environmental conditions, or failure to follow operating and maintenance instructions may not be covered.

For warranty information relating to a specific product, please contact Fire Garden or your Authorized Fulfilment Center.

18. Third-Party Services

Fire Garden may provide information about or connect customers with Authorized Fulfilment Centers, dealers, installers, contractors, manufacturers, or other third parties.

Unless expressly stated otherwise, these third parties operate independently from Fire Garden.

Fire Garden is not responsible for the acts, omissions, representations, workmanship, pricing, scheduling, or services of independent third parties.

Any agreement for installation, construction, site preparation, delivery, or other services provided by a third party may be governed by a separate agreement between the customer and that provider.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Fire Garden and its owners, employees, representatives, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the purchase, installation, use, inability to use, or performance of a Fire Garden product.

This limitation may include, without limitation, damages relating to property, lost use, lost profits, business interruption, installation costs, or other consequential losses.

Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

20. Website Use

All content on this website, including text, photographs, graphics, logos, product information, designs, and other materials, is owned by or licensed to Fire Garden unless otherwise stated.

You may not reproduce, distribute, modify, publish, transmit, sell, or otherwise use website content for commercial purposes without prior written permission from Fire Garden.

Fire Garden reserves the right to modify, suspend, or discontinue any portion of the website without notice.
